摘要
乡村振兴战略的实施离不开完善的顶层法律制度设计的规范、保障和引领。改革开放以来,我国的"三农"领域立法虽已取得较快发展,但随着城镇化与农业、农村现代化进程的加快,在乡村振兴背景下,现有立法在回应乡村发展与社会转型所面临的新问题时仍显不足。因而,乡村振兴立法需要在修正现行基础立法不足、重塑"三农"法律体系以及克服过分依赖政策推进"三农"领域改革的弊端等方面发挥重要作用。同时,在制定有关乡村振兴的统一立法时,应当遵循纲领性与可操作性并重、坚持农民主体地位以及科学、民主、依法立法等原则。一方面,既要注重构建乡村振兴的基本组织架构及法律制度框架,又要明确相关措施的实施标准、程序和监督问责机制;另一方面,应当以实现农民主体地位、促进农民全面发展为依归,强化立法对农民平等参与及发展权利的保障。
The implementation of rural revitalization strategy cannot be separated from the regulation guarantees and guid-ance of perfect top-level legal design.Since the reform and opening up,the legislation in the field of“agriculture,the cou-ntryside and farmers”has made rapid development,but the existing legislation is still insufficient in responding to the new problems of rural development and social transformation under the background of rural revitalization.Therefore,the rural revitalization legislation needs to play an important role in revising the deficiencies of current basic legislation,remolding the legal system of“agriculture,the countryside and farmers”and overcoming the drawbacks of overdependence on policies to promote the reform of“agriculture,the countryside and farmers”.Meanwhile,in the process of legislation on rural revi-talization,we should follow the principles of placing equal emphasis on programmability and operability,adhering to the principal status of farmers,and legislating scientifically,democratically and legally.On the one hand,we should lay em-phasis on the construction of the basic organizational structure and legal system framework for rural revitalization,and clari-fy the implementation standards,procedures and supervisory mechanism of relevant measures;on the other hand,we should strengthen legislation on equal participation and development rights of farmers for the purpose of the realization of the principal status of farmers and the promotion of their all-round development.
