摘要
农村集体经济组织立法首先要回答立什么样的法的问题。农村集体经济组织法应定位为私法、组织法。其以社区型农村集体经济组织为调整对象,以规范其组织与行为为主要内容,旨在明确法人组织建构,理顺其与成员、其他民事主体之间的权利义务关系。在立法时应以法律规定和法人自治相结合为原则,构建“一般法+特别法+法人自治”的调整体系。农村集体经济组织立法应理顺其与《村民委员会组织法》《农民专业合作社法》《公司法》等法律之间的关系;在内容设计上,应采用团体法的思维,以设立、运行和终止三个阶段为脉络构建整体框架结构。
The legislation of rural collective economic organizations should first answer the question of what kind of law to establish.It takes the community type rural collective economic organization as the adjustment object and standardizes the organization and behavior of the rural collective economic organization as the main content.In the legislation,the normative system of"general law+special law legal+person autonomy"should be constructed based on the principle of the combination of legal provisions and legal person autonomy.The legislation of rural collective economic organization should straighten out its relationship with the Organic Law of villagers’Committee,the Law of Farmers’Professional Cooperative,the Company Law,etc.In the design of content,we should adopt the thinking of group law and construct the whole frame structure with the three stages of establishment,operation,and termination as the context.
