摘要
耕地具有重要的生态资源价值。生态增益是进行耕地生态保护补偿的正当性依据,对产生生态增益做出实质性贡献是耕地生态保护补偿对象确定的标准。土地承包经营权人是耕地用途限制的直接经济利益受损者,应当是补偿的对象;土地经营权人履行耕地使用方式的限制,承担耕地整体性保护义务,对产生生态增益做出了实质贡献,亦应当是补偿对象。地方政府对耕地的使用环境进行宏观治理,对耕地产生生态增益具有支持作用,但是作为公共利益的代表者,政府履行职能不能要求获得补偿;农村集体经济组织对耕地使用产生生态增益只起辅助作用,不是直接的生态增益贡献者,亦不应当作为耕地生态保护补偿对象。
Cultivated land has an important ecological resource value.Ecological gain is the legitimate basis for cultivated land ecological protection compensation,and making a substantial contribution to the ecological gain is the standard for determining the compensation object of cultivated land ecological protection.The land contracted management right holder is the person whose direct economic interests are damaged by the restriction of cultivated land use,and should be the object of compensation;The land management right holder fulfills the restrictions on the use of cultivated land and undertakes the obligation of overall protection of cultivated land,who has made a substantial contribution to the ecological gain,and should also be the object of compensation.The local government carries out macro governance on the use environment of cultivated land,which can support the ecological gain of cultivated land,but as the representative of public interests,the government cannot claim compensation;Rural collective economic organizations only play an auxiliary role in the ecological gain of cultivated land use,which are not direct contributors to ecological gain,so they should not be the compensation objects for cultivated land ecological protection.
