摘要
在资源主导型的经济发展模式下,矿产资源无疑是我国经济社会发展的重要支柱。但矿业是高污染行业,特别是近年来我国矿产资源持续大规模的勘探开采,引起了一系列严重的矿山环境问题,矿山生态环境急剧恶化,其影响已涉及经济社会发展的方方面面,因此加强和完善我国矿山生态环境制度建设至关重要。文章首先介绍了我国矿山环境恢复机制的现行制度框架,在此框架的基础上,对我国矿山环境状况恶化的现实进行了深层次的原因分析,剖析了目前我国针对矿山环境问题的意识、立法执法、资金技术的现实状况。接下来,对我国矿山生态环境恢复治理机制进行了宏观构建。笔者认为,要从三个方面对我国的矿山生态环境恢复机制进行构建。首先是调整矿山生态环境保护法律制度;第二,完善矿山环境保护机制;第三,建立矿山企业自身环保机制。
The mining resouree is the most important support to the economic and social development nf China on the ground of the resource leading developmental model. But the mining is a high-contaminated industry, and the recent large-scale exploitation has arisen a series of serious mine environmental problems. It is important to establish the mine environmental mechanism. The article first introduced the theory frame of mine environmental reclamation and resumption mechanism in China. On The basis of the frame, it analyzes the causes of the mine environmental problems, introduces the realistic condition of consciousness of mine environmentproblem, the legislation and execution of the law, fund and technology in China. Then, construct the mechanism of the mine environment resumption and reclamation. The mechanism of the mine environment resumption and reclamation should be constructed from three aspects： adjust the legal regime of mine ecological environmental protection, perfect mine environment protection mechanism,and establish environmental protection mechanism of nfine enterprises.
