摘要
学生申诉权是学生享有的一项法定权利。人权保障、权力制约、程序公正是学生申诉权的法理基础,学生申诉权是一项制度化的基本人权,是宪法性权利的具体化,是获得权利救济的程序权利。学生申诉权的实现和保障需要建立和完善学生申诉制度。
The right to petition is one of legal rights that the students should have. The safeguard of human rights, the restriction of powers, and the impartiality of procedures lay the jurisprudence basis. It is one of the systemized basic human rights, the concrete rights of constitutionality conferring on, and the procedural rights to acquire the redress of grievance. And its realization and safeguard need to establish and improve the system of students＇ petition.
