摘要
知识产权制度在几百年的发展中 ,一个重要特点是知识产权的不断扩张。这种扩张在不同的知识产权中都有体现 ,特别是在著作权、专利权和商标权中表现尤为突出 ;具体体现为权利保护客体扩大、权利内容增多、权利期限延长等方面。知识产权的扩张背后是利益平衡机制在起作用。知识产权作为一种平衡和协调知识产权人和社会公众之间的利益关系的法律 ,在一个特定的历史时期需要通过知识产权的扩张维持一种动态平衡关系。
In its development of several hundred years, an important hallmark of intellectual property right system is its constant expansion.Such an expansion shows in various fields,particularly in copyrights,patents and trademarks. It specifies in the ever-increasing protected objects and contents, the extension of the period of validation and the like. The mechanism of balancing interests operates behind it. As the intellectual property right law is a law balancing and coordinating interests between the owner of the intellectual property right and the public, we need to maintain a dynamic balanced relationship with it in the special historical period.
