摘要
驰名商标跨类保护所依据的理论有混淆理论和淡化理论,二者以保护商标的不同功能为基础,具有不同的适用条件和适用区间。我国驰名商标保护在司法实践中存在的问题与没有区分二者的不同有关。混淆保护以混淆可能性来要求商标驰名度,所以不同的案件有不同的驰名要求,依据混淆理论所获得的驰名商标权利不具有绝对排他的属性。淡化保护对商标驰名度有较高较确定的要求,一般来说,只有在全国范围内为公众所熟知的商标才能享受淡化保护,淡化保护下的驰名商标具有绝对权的性质。只有区分两种保护的不同并明确其适用条件才能理顺我国的驰名商标保护制度。
The protection crossing category of well-known trademark is based on confusion theory and dilution theory, which have distinctive function and applicable conditions. The trademark rights based on confusion theory are not a kind of right, which has an exclusive effect. Much differently, the rights based on dilution theory are a kind of exclusive right. The requirement of famous degree is different in two modes. There is no unified standard in the confusion theory but higher and more definite demand in the dilution theory.
