摘要
对于商标法律制度变迁过程中出现的商标权扩张趋势与竞争政策的适应性应一分为二地看待。一方面,以商标权扩张为主要内容的商标法律制度的变迁总体来说并未背离促进和维护公平有效竞争的价值取向,商标权扩张的大部分内容应理解为商标法与竞争政策的与时俱进;另一方面,在利益集团影响下,商标权的扩张不惜以牺牲公共利益为代价,使商标法在某些时候向背离竞争政策的方向发展——过于彰显其财产保护功能而淡化了其作为竞争政策工具的社会功能。
Abstrast: The adaptability between the trademark right expansion and competition policy arising in the development of trademark law system should be analyzed in two aspects. On one hand, the development of trademark system, which emphasizes the expansion of trademark right, does not deviate from the value orientation of promoting and maintaining the fair and effective competition. On the other hand, under the influence of the interest groups, the trademark right is expanding at the expense of public interest, making the trademark law at some point develop in the opposite direction of competition policy, and in this case, the property protection function of trademark law eclipses the social function as the tool of competition policy.
