摘要
著作权保护在几百年的发展历史中具有扩张的趋向。这种扩张总体上表现为保护客体的扩大、保护期限的延长、保护范围的扩大、对个人性质使用限制的增强等方面。著作权扩张可以从法律与经济学的角度加以解释。从著作权法的利益平衡理论分析,通过著作权扩张,在一个特定时期实现了著作权人与社会公众利益之间的平衡,从而能够更好地实现著作权法的宗旨。从经济学的分配效率分析,著作权的扩张是优化资源配置的结果。
The proctection of copyright have a outstretched trend in the developing history for several hundreds years.,as a whole,this trend is represented in these aspects inclding the object protected are broadened ,term protected are prolonged and the use limit on individual character are gathered head.The expansion of copyright could be explained from the angles of law and economics.accoding to the theory of interest balance of copyright ,the expansion of copyright realize the balance between copyright and the interests of social public in a special period , consequently realize the tenet of copyright law.accoding to the efficiency of distribution ,the expansion of copyright is a result of optimzing resource collocation.
