摘要我国《行政诉讼法》从法律层面确立了检察机关提起行政公益诉讼制度。行政公益诉讼诉前检察建议启动机制作为该制度的重要组成部分,在解决公益受损、节约司法资源上功不可没。行政公益诉讼诉前检察建议启动机制主要包含启动主体、启动目的、启动程序以及启动标准等内容。当前,我国行政公益诉讼诉前检察建议启动机制主要存在案件线索来源有限、行政机关履职标准模糊以及检察机关调查核实困难等问题。行政公益诉讼诉前检察建议启动机制应当从三个方面改进和完善:一是拓宽案件来源渠道,丰富启动机制的运行起点;二是明确行政机关履职认定标准,夯实启动机制的运行基础;三是强化检察机关调查核实权,保障启动机制的运行效果。 China’s“Administrative Litigation Law”has established the system of administrative public interest litigation brought by procuratorial organs at the legal level.As an important part of this system,the starting mechanism of pre-litigation prosecution suggestions in administrative public interest litigation has made great contributions to solving the problem of public interest damage and saving judicial resources.The starting mechanism of pre-litigation prosecution suggestions in administrative public interest litigation mainly includes the starting subject,starting purpose,starting procedure and starting standard.At present,the starting mechanism of pre-litigation prosecution suggestions in administrative public interest litigation in China mainly has the problems of limited sources of case clues,blurred standards of administrative organs’performance of duties,and difficulties in investigation and verification by procuratorial organs.The starting mechanism of pre-litigation prosecution suggestions in administrative public interest litigation should be improved and optimized from three aspects:first,broaden the channels for case sources and enrich the starting point of the operation of the starting mechanism;secondly,clarify the identification standards for administrative organs’performance of duties and consolidate the operating foundation of the starting mechanism;thirdly,strengthen the investigation and verification power of procuratorial organs to ensure the operating effect of the starting mechanism.
