摘要
为落实积极应对人口老龄化的国家战略,保障老年人老有所养,推进全国性养老服务立法工作已势在必行。在梳理和总结现有养老服务规范的基础上,未来养老服务立法应当着力关注和解决包括阐释养老服务的规范内涵、建构以宪法为核心的养老服务法律体系、合理设计养老服务立法文本结构、规范表达养老服务体系、归纳养老服务立法原则、明确养老服务义务主体职责、建立长期护理保障制度、加强农村养老服务立法、完善养老服务立法之法律责任设定、推动养老服务立法法典化在内的十大关键问题。
To implement the national strategy of actively responding to population aging and ensure that the elderly are well cared for in their old age,it is imperative to advance the national legislation on elderly care services.Based on a comprehensive synthesis of existing elderly care service norms,it is found that future legislation on elderly care services should focus on and address ten key issues,including clarifying the normative connotation of elderly care services,constructing an elderly care service legal system centering around the Constitution,rationally designing the structure of the elderly care service legislation texts,standardizing the expression of the elderly care service system,summarizing the principles of elderly care service legislation,clarifying the responsibilities of the duty subjects of elderly care services,establishing a long-term care security system,strengthening the legislation on elderly care services in rural areas,improving the setting of legal responsibilities in elderly care service legislation,and promoting the codification of elderly care service legislation.
