摘要
国家安全体系和能力现代化离不开区域应急合作的法治化。应急背景下,区域合作呈现出有别于常态“发展型区域合作”模式的“防御型区域合作”模式新图景。在信息化时代,以数据技术主导、多方主体参与为特征的新区域主义的应急结构成为跨区域应急的主导治理框架,展现了国家安全体系和能力现代化的新理路。在应急法体系的运作过程中,应急防御型区域合作的实施并不规范,尤其体现为区域间应急决策标准的不统一,削弱了区域在实现国家安全中的基础作用。在法秩序统一性原理的检视下,应急行政中的应急指挥机构及其发布的应急行政命令均应受到法秩序统一性框架的约束。为规范应急背景下区域之间的一体化实践,缓和风险系统性与区域分割管理体制之间的张力,通过区域合作助推国家安全,央地政府以及相关主体必须在科学与法治价值的引领下统筹共进。这需要事前在规范层面完善区域合作立法保障机制,在合作之中通过多样化的激励机制增进区域合作动力,以及在事后通过监督与行政自制抑制应急权力的扩张。
The modernization of national security and capabilities cannot be achieved without modernizing the legal framework for regional emergency cooperation.In emergency situations,regional cooperation takes on a new form of“defensive regional cooperation”,distinct from the normal model of“developmental regional cooperation”.In the age of information,the dominant governance structure for cross-regional emergencies is a kind of new regionalism characterized by data technology prevalence and multi-party participation,which demonstrates a new path to the modernization of the national security system and capabilities.However,the implementation of this emergency legal system is not standardized,particularly with regard to the lack of uniformity in emergency decision-making standards between regions,which undermines the fundamental role regions play in national security.Therefore,under the Principle of the Unity of Legal Order,emergency command institutions and emergency administrative orders issued by them in emergency administration should be subject to the framework of the Unity of Legal Order.To ensure consistent practice between regions in an emergency,reduce tension between the systematicness of risk and the regional division management system,and promote national security through regional cooperation,the central and local governments and relevant parties must work together in a synergistic manner guided by science and legal values.This requires improving the legislative protection mechanism for regional cooperation in advance at the normative level,increasing the motivation for regional cooperation through diversified incentives during cooperation,and restricting the expansion of emergency powers through supervision and administrative self-restraint after the event.
