摘要
在大数据背景下,患者健康信息存在诸多方面的问题,其中信息所有权牵扯到各方利益。目前多数文献仅针对患者隐私权,而研究所有权的相对较少,且多数研究只将患者信息所有权视为一个科研主题的某个方面,未专门对患者信息所有权问题进行深入探讨。从个人健康信息的特殊性出发,剖析了患者健康信息所有权的归属问题。参考其他国家关于患者信息所有权的讨论,系统梳理了患者信息所有权的研究现状,着重分析了患者信息所有权归属不明确会带来的潜在问题和冲突,并提出4个具体的对策建议。
Many unanswered questions exist about the patient health information in the context of big data.Among them,patient data ownership involves the interests of many stakeholders.At present,most research only focuses on patient privacy rights.In contrast,relatively few studies on patient data ownership,and most studies only examine patient ownership as one aspect of a scientific research topic.The issue of patient information ownership has not been investigated in depth.This study analyzed the unique features of patient data to discuss its ownership.We compared the legal debates of patient data ownership from different countries.Potential problems and conflicts were identified that could be caused by the uncertain ownership of patient data.We also offered four specific recommendations to prevent or solve these problems.
