摘要
法治有助于促进城市社区外在形式秩序与和谐共同体的形成。实现社区自治、法治、德治相结合是城市社区治理的主要目标。城市社区法治化治理体系由多元治理规则体系、多元治理主体体系、多元治理方式体系等基本要素构成。应该通过转化街道办事处(乡镇)政府职能、强化社区居委会的自治功能、培育社区内其他组织参与社区治理,进而优化社区治理多元治理主体体系;制定社区自治专门性法律、修订现行居委会组织法以及安排相关配套制度,进而完善社区治理多元治理规则体系;发挥法治保障功能、彰显德治引领价值、明确自治基础地位,进而健全社区治理多元治理方式体系。
The rule of law helps to promote the formation of external formal order and harmonious community in urban communities.The main goal of urban community governance is to achieve the combination of community autonomy,rule by law and rule by virtue.The legalized governance system of urban communities is composed of basic elements such as a multi-rule system,multi-subject system,and a multi-method system.It is suggested to optimize the multi-subject system of community governance by transforming the government functions of sub-district offices(townships),strengthening the autonomous function of community neighborhood committees and cultivating other organizations in the community to participate in community governance;We should improve the multi-rule system of community governance by formulating specialized laws for community autonomy,revising the current neighborhood committee organizational law and arranging relevant supporting systems;We should improve the system of multi-methods for community governance by giving full play to the function of legal protection,demonstrating the leading value of the rule of ethics and clarifying the basic status of self-government.
