摘要
本文从法学中“罪”与“罚”的概念入手 ,讨论我国城市规划法中的刑事法律责任设定的问题。文中首先对我国城市规划法律和实践中刑事法律责任缺失的现状进行阐释 ,进而分析产生这一现象的原因 ,最后对在我国城市规划法律中设定刑事法律责任的若干问题作了探讨。
The paper analyses the reasons of the neglecting on criminal responsibility in urban planning practice and law in China. The paper discusses the issues of creating the criminal responsibility in China's urban planning legislation based on the concepts of crime and penalty,as well as the practical needs.
