摘要
知识产权法不仅具有民法保护私权的功能,同时更具备商法促进商事交易的属性。知识产权制度在起源上兴起于商事交易发展的历史背景,调整对象具有营利性,法律规范上强调技术性,发展趋势上有国际化倾向。知识产权法遵循商法的若干原则,包括促进交易便捷、保护营业利润和维护交易安全等原则。在知识产权改革取向上应当采取与商法相协调的态度,在促进市场机制发挥作用、协调任意性和强制性规范等方面予以改革。
Intellectual property law can not only protect private rights but also promote commercial transaction. Intellectual property originates from the development background of commercial transaction. So just like commercial law, intellectual property law regulates business behavior, emphasis on technical rules and becomes international. What＇s more, intellectual property law follows some basic commercial law principles, including facilitate transaction, protect profits and improve the safety of transaction. Intellectual property law should focus on promoting commercial transaction and coordinating the arbitrarily and compulsory rules in order to keep pace with commercial law.
