摘要
在新能源产业上,我国与美国起点相近,现在中、美两国都将经济转型发展的重点放在具有战略性的新能源产业上,已经进入利益碰撞期,围绕新能源产业的贸易摩擦呈常态化将是不可避免的趋势,需要谨慎研究对策。美国启动对我国新能源产业的301调查,主要的争议在于我国对新能源产业提供的优惠措施是否属于SCMA协议所规定的专项性补贴,这是区分正当的经济社会政策,还是扭曲国际贸易、剥夺其他国家合法贸易机会的不公平贸易行为的关键。我国政府在维护国家利益、积极抗辩的同时,应完善新能源政策法律体系,一方面参照WTO规则和美国的一些成功做法,改进我国的扶持政策,发挥政府的主导作用,加强对新能源发展规划协调、标准规范制定以及对技术研发的支持,开拓国内市场;另一方面推动新能源企业走出去,主动打破国际贸易壁垒。
China and the United States started their new energy industry almost at the same time. Now the two countries both focus the development of economic transformation on new strategic energy in- dustry. Hence the inevitable interest conflict in new energy trade. The "301 Investigation" initiated by the US against Chinese new energy industry targets at our preferential measures in new energy in- dustry. The issue is whether those measures belong to the special subsidies stipulated in the SCMA, which is the key to discriminate it is an allowable economic and social policy or an unfair trade practice to distort international trade and deprive legal trade opportunities of other countries. While maintai- ning our state interests and taking an affirmative defense, we should improve our policies and regula- tions concerning new energy.
