摘要
网络的特殊性与未成年人的生理心理特征相结合极易诱发犯罪,文章通过实证研究分析并借鉴犯罪场和引力场理论,认为应研制过滤和屏蔽网络不良信息的软件,加强网络立法,完善监护人、网吧经营者、网络内容提供者和网络服务提供者的法律责任,对无法监管的未成年人,可以由公安机关辅助监护,必要时可以给需要监护的未成年人佩戴电子监控仪,应在有条件的地方设立网矫学校,在现有的学校内设立网矫班,对需要矫治的未成年人进行矫治和教育。
The combination of internet's distinctiveness and physical-mental feature of minors will easily induce minors to commit crime.Through the analysis of the data from empirical studies and the borrowing of crime field theory and gravitation field theory,this article argues that the software to screen and shield harmful information should be developed,network legislation should be enhanced,legal liability of guardians,the owners of cybercafe,web content providers and web service providers should be improved,subsidiary guardianship should be exercised by public security bureau for those who fail to be under guardianship,minors who need necessary special guardianship should be required to wear electronic monitor device.The article also suggests internet addiction-correction school or internet addiction-correction class in ordinary schools should be set up as quickly as possible wherever conditions permit so that those who need correction can be sent there.
