摘要
研究目的:研究中国农村土地制度下农民土地权利的内容和结构体系。研究方法:文献资料法,归纳演绎法和分析综合法。研究结果:(1)农民土地财产权体系化应从农民主体性视角并在财产法框架下考量其多重权利属性;(2)传统农民土地权利物权体系不能涵盖农民土地财产权的丰富内容;(3)农民土地财产权体系构建的关键在于对农民在农村土地上的财产利益进行科学的类型化,应包括土地上的归属利益、使用利益、流转利益和未来权益等财产利益;(4)农民主体不同性质的身份决定了土地财产权的不同属性。研究结论:农民土地财产权的各种形式之间是密切联系又独立平等的。
The purpose of the paper is to study the content and structure of land rights in the context of Chinese rural land system. Research methods include documentation, inductive and deductive, and synthesized analysis. The results indicate that reconstructing land property of farmers should recognize the subjectivity from the perspective of property law, as well as the multiple features of the rights. The traditional system can not cover the rich meanings of the land property rights. The emphasis of reconstructing the rights is to clearly categorize the bundles of rights of the rural land, including land ownership, rights of use, rights of transfer and the option value. The different natures of the farmer determine the different attributes of land property. The paper concludes that the property rights of farmers are closely linked but clearly separated.
