摘要
农民土地财产权是指作为农村集体经济组织成员的农民对农村集体土地所依法享有的各种财产利益的自由和资格。农民土地财产权是以宪法为基本依据的民事财产权。农民土地财产权的权利主体"农民"应当是指农村集体经济组织成员,作为权利主体具有多维性的特质。农民土地财产权是以农村集体土地为基本客体的不动产财产权,农村集体土地具有资源性、资产性、空间性和层次性的特征。农民土地财产权是农民在农村集体土地上应当拥有各种财产利益的权利,包括以土地归属为财产利益的权利、以土地利用为财产利益的权利、以土地流转为财产利益的权利和以预期利益为财产利益的权利。
Land property right of farmers refers to farmers freedom and qualification of the various property interests on the land as collective rural members, which is the civil rights based on the Constitution. ＂ Farmer＂ means members of rural collective organizations, which has a multidimensional characteristics . Rural land is the object of real property with characteristics of resources, assets, spatial and hierarchy. The land property right of farmers includes land ownership rights, rights of land use, transfer rights and the expected benefits for the property.
