摘要
金融危机以来,东南沿海出现大量的外资非正常撤离事件。本文分析了撤资者应承担的民事、行政、刑事三类法律责任,研究了通过诉讼追究非正常撤资者法律责任的现实障碍,并对于克服障碍、维护中国相关利益方的合法权益提出了可行的法律对策。
Since the financial crisis occurred,ther e have been a lot of illegal divestments of foreign capitals in the southeast China costal areas.This paper anglicizes the civil,administrative and criminal obligations of the divestors,researches the practical difficulties for litigations to the foreign investors who have withdrawed the capitals illegally,and advances several legal suggestions for conquering the difficulties and protecting the legal rights of Chinese interested parties.
