摘要
行政自制是指行政主体自发地约束其所实施的行政行为,使其行政权在合法合理的范围内运行的一种自主行为,即行政主体对自身违法或不当行为的自我控制。在现代政府理念和行为方式之下,惠民理念的兴起、行政权的规范行使、行政主体和行政方式的多元化趋势等为行政自制的实现提供了充分的现实可能性。
Self- restraint in administration means the administrative body restraint its behavior autonomically and behave legally and reasonably, which means that the administrative body restrain its behaviors itself . There are a lot of factors, including the theory of benefiting the people, normative exercising of power, and the tendency in diversification of the administration subject and administrative practice, which will promote self- restraint in administration .
