摘要
为建立有效途径、改善担保操作,根据中国复杂市场环境和立法习惯,对限额以上工程项目采用统一的强制标准;论述品种规制与自选结合,人保、物保与非传统担保共存的机制,包括建筑许可责任、总包付款的强制保证担保及保额标准或亚种,履约、分包和杂项等自选约定担保;指出项目当事人包括政府大业主只能在法定框架内行使自治要求,应当调整的四组关系和具体路径。
To establish valid channel and improve regulation provision, this paper adopts identical compulsory standard for construction project above stipulated limit;it expounds the mechanism combined by variety regulation and selection, surety-bond, matter-bond and non-tradition-bond according to Chinese complicated market environment and legislation custom,includlng the compulsory construction permit surety-bond and payment surety-bond and their variety standard or sub-variety, optional performance, sub-contractor, miscellaneous bond; it also points out the project-party including great-owner of public project should exercise power of self-government within legal frame, and four relations to be adjust and its concrete route.
