摘要
通过对深圳、厦门推行工程担保制度试点情况的调查,本文着重对两地实施的强制性工程履约担保制度在公共工程中的试行效果进行了分析研究。鉴于差额担保的应用事实上已经在向高保额方向发展,因此建议两地可以适当考虑用高保额有条件保函取代目前这种准高保额的无条件保函,以减轻承包商为提交保函所承受的资金负担。
Based on the survey for the pilot system of construction bonding in Shenzhen City ＆ Xiamen City, the features and effects of construction performance bonding practices for public works in these two cities are concluded and analyzed. It＇s found that the performance bonding system works quite well in the public works, and it even goes close to high-penalty-bond model given the use of differential bond together with performance bond. It＇s advised that high penalty conditional bond should be used to replace the current quasi high penalty unconditional bond.
