集体建设用地入市的产权障碍、负面影响及对策 被引量:5

On the Barrier of Collective Construction Land Freely Bought and Sold and Its Negative Influence and Countermeasures

摘要 农村集体建设用地入市流转是我国经济发展的必然要求,其势在某些经济发达地区已不可遏止,然而,所有权归属不清、使用权受过多限制、处分权和收益权残缺等产权制度障碍使农村集体建设用地在流转中产生许多矛盾和问题,因此,解决农村集体建设用地在流转中的产权制度障碍成为当务之急。具体对策为:明确所有权主体,保护农村集体建设用地所有权;放宽对使用权限制过多;保护农村集体建设用地处置权和收益权等。 It is an inevitable request of our country economy development that countryside collective construction land is freely bought and sold on the market,which is already out of control in some developed areas.But,the property order obstacle, such as vague proprietary fight, limitations to servitude and lack of disposition and usufruct, has led to many contradictions and problems of countryside collective construction land on the market, So, removing the property fight barrier of countryside collective construction land becomes an urgem affair by means of clearing the main body of proprietary right, protecing the proprietary right of the countryside collective construction land, loosening the ovennany limitations to the servitude and safeguarding the disposition and usufruct of the countryside collective construction land.
