摘要
从职业运动员工作合同的具体条款、法律性质、我国及欧美体育职业化比较发达国家的司法实践等几方面进行探讨,认为职业运动员工作合同属于一种劳动合同,应受劳动法律关系的调整。此外,从合同构成的角度出发,提出签订职业运动员工作合同必须约定运动员的职责描述、表现评价和俱乐部的组织制度三方面事务,并由这三方面的表述共同构成合同的必备条款和补充条款。
The work contract of professional athletes is of the most importance to the protection of the rights of the athletes. This study, on the basis of the approach of terms and conditions of the professional athletes" work contract, legal essence, legal practice in professional sports of more developed cotmtries in Europe and USA as well as in China, holds that it belongs to a labor contract and shall be governed by the labor Law. Besides, from the perspective of the constitution of contract, it suggested that professional athlete" s work contract shall include three aspects, the duty description of athletes, the evaluation of performance, and the organization system of the club, which together form the necessary and supplementary terms and conditions of the contract.
