摘要
通过查阅《劳动法》和《新劳动合同法》、国际足联《球员身份与转会规定》与《中国足球协会运动员身份及转会规定》,对中超球员的自由转会进行研究。研究表明:中国足协现行的转会制度无视球员的利益,限制了球员的发展,不仅违背了中国的劳动法,也与国际足联的转会规则相抵触,因此,修改、完善足球转会制度势在必行。
The beginning of the 2009 - 2010 season, "ZhouHaiBin transfer events" made great noise. It give a lesson to the Chinese football, thus Chinese soccer association has been pushed from this in the teeth of the storm, while "on a free transfer system" has become the focus of hot debate. Through the literature material, the labor law and the new labor contract law, based on the status of FIFA's transfer regulations with players with the Chinese football association transfer regulations and athletes to compare, players of Chinese football super league on a free transfer. Research shows that : the Chinese football association current transfer system, ignore the player has limited the development of players, not only against the Chinese labor law, also with the transfer rules of FIFA , the reform must be taken on.
