摘要
通过对土地利用规划中公众参与实施的必要性进行理论探讨,提出土地利用规划中公众参与的层次差异,分析土地利用规划中公众参与制度现状、实施现状和存在的不足。研究表明:土地利用规划中的公众参与具有层次性;当前土地利用规划中存在一定程度的参与过程,但总体上说尚处于起步阶段,问题较多。公众参与作为土地利用规划的重要组成部分,应尽快建立和健全相关法律制度,增加规划透明度和公开性,尊重和保障公民权利,改进和完善参与方法,重视公众的监督修改意见,实现土地利用规划由静态规划向动态规划的转移,保障区域的可持续发展。
On a theoretical study of the necessity of public participation in land use planning, this paper points to the different levels of public participation in land use planning and analyzes the necessity and actuality of public participation in land use planning. The paper concludes that there are some problems in public participation in land use planning, and that it is imperative to establish and perfect corresponding laws and regulations, to respect and secure the right of the public, to improve the methods of participation, so as to realize the conversion of land use planning from static to dynamic and to guarantee the sustainable development of the .area.
