摘要
近现代以来,美国法理学界众多法学思潮日新月异、竞相争夺话语的权力。尤其是近20年来,后现代法学在美国的兴起,使得美国法理学研究现状及其未来走向,更加变幻莫测、难以琢磨。结合后现代主义思潮兴起的知识背景,以及美国独特的社会文化、政治、法律传统,从美国学界近来关于法律解释的论争入手,拨开美国法律解释学的迷雾,以探究美国法律解释机制在保守与激进之间进行均衡与妥协,对美国宪政的稳定与发展的重大意义。这对变迁中的当代中国社会不无启迪。
With the global upheaval of postmodernism as the intellectual context and the American unique cultural, political and legal tradition as the earnest consideration, the essay attempts to pierce through the thick frog hovering over American legal interpretation via the latest debate on the hot issue in order to disclose the function of mediation and reconciliation of the American interpretative institution and its function in the stability and development of the American constitutional structure. It seems that much edification can thus be drawn for current Chinese society which is confronted with numerous transitional challenges.
