摘要
特许经营权已日益成为无形财产权体系中的一项重要类型 ,明确特许经营的概念 ,进而明确了特许经营权的概念 ,特许经营权的客体可界定为一种“资格或能力”。特许经营权作为现实中的具体无形财产权 ,必须由民法予以确认 。
The right of franchise is becoming a important form of the system of intangible property right. Make the concept of franchise clear, then we can wake the concept of the right of franchise. The objectivity of the right of franchise is defined as a 'competency or ability'. As a concrete intangible property right in the reality, the right of franchise must be consented by civil law. There is no obstacle in theory.
