摘要
商业秘密作为信息是一种有价值的稀缺资源之一 ,有必要将其作为财产权加以保护。同时 ,商业秘密又是一种未公开的信息 ,这就决定了它在财产权体系中是一种特殊的知识产权。这样界定商业秘密的法律性质 ,有助于商业秘密的研究与开发 。
This paper describes commerce secret as information is one of economic value information resources. So commerce secret information as a property right must be provided by legal protection and also it is information covered. It is determined that the commerce secret information is a kind of special knowledge property right of a system of property rights. Law nature limits of commerce secret determined by measurement provided for by law can promote research and development on commerce secret, which is beneficial to economic growing and scientific progress.
