摘要
从我国公司立法出发 ,在明确公司法人财产权及其与股权的关系的基础上 ,分析了关于股权的各种观点 ,对股权的概念作了一番理论探讨 ,认为股权是基于公司法的规定 ,股东因出资而享有的一种以经济利益为核心的 。
According to our Company Law and based on the legal person's property rights of corporation and its relationship with stockholder's equity, this paper reviews some major opinions on stockholder's equity and analyses the concept on stockholder's equity theoretically. Then this paper proposes that sotckholder's equity, based on the stipulation on company law and enjoyed by the stockholder who invests in corporation, is one of property rights whose core is economic interests having the characters of control, request and transaction.
