摘要
公司法人成立后即享有公司的独立人格,公司的财产即独立于股东的个人财产,可以独立对财产进行占有、使用、收益和处分。股东出资后即丧失对所出资财产的独立权利并转化为公司股份,股东通过股东大会等为桥梁和纽带行使所享有公司的股份权利。公司法人财产权与股东的股份权利既相互独立又相互制衡。
TJuridical person enjoys the privilege of occupying, using, settling as well as benefiting from corporate＇ s property. Stockholders loses their independent right over invested property, however, they can enjoy share rights by way of general meeting. Juridical person＇s property rights and stockholders＇ share rights are mutually independent and conditioned.
