摘要
"三权分置"背景下的土地经营权承载着重要的财产价值属性,对维护农民的土地权益和实现农业生产适度规模化意义非凡。但土地经营权作为一项新型权利面临着法律属性界定不明的困境。学界对于土地经营权的物权债权属性产生了激烈的争论,二元思维模式的局限使法律属性界定陷入僵局。突破传统民法二元思维,将土地经营权界定为高度物权化的新型财产权利,既保留土地经营权物权化的特征,又避免了法律属性界定逻辑上的瑕疵。此界定方式使土地经营权的确权与流转得到了保障,有利于推进农地制度改革的进程。
The land management right under the background of"the separation of three rights"bears important property value attributes and is of great significance for safeguarding farmers' land rights and realizing a moderate scale of agricultural production.However,as a new type of right,land management right faces the dilemma of unclear definition of legal attributes.In the academic circles there is a fierce debate on the property right and liabilities of land management right.The limitation of the dualistic thinking model has made the definition of legal attributes deadlocked.Therefore,it is necessary to break through the traditional dualistic thinking in the civil law and define land management right as a new type of property right with a high degree of real right.In this way,the characteristics of the property right of land management right is retained,while the logical defect of defining the legal attributes is avoided.This way of defining the land management right has guaranteed the confirmation and transfer of the right and promoted the process of agrarian land system reform.
