摘要
点击合同是电子商务的主要交易形式,是电子商务时代的新型格式合同。点击合同具有主体特殊、以互联网为媒介、存在特定的不公平条款等特点。点击合同虽然具有一定的优点与存在的必然性,但仍需从立法与司法两个层面对其进行规制。
Clickwrap contract is the major transaction form in EC, it is a new type of standard form contract at EC times. Clickwrap Contracts have special subjects, use internet, have specific unfair terms. Although clickwrap contracts have some advantage, we still regulate them through legislation and administration of justice.
