摘要
农业植物新品种的开发仰赖于科技创新,其推广和应用必须接受WTO规则的约束。作者认为,必须加强对农业植物“品种权”的法律保护:高度重视农业转基因作物生产的安全管理;严格按《种子法》等法律规范认定和推广农业植物新品种,并在研制、生产、销售过程中依法调解各种纠纷;惩处严重侵犯农业植物新品种权的行为。
The new strains' exploration of agricultural plant depents on scientific and technological innovation, spread and application must accept the bourds of WTO rules. In this paper the author holds that there is need to strengthern legal protection of the right of strains about agricultural plant, think highly of safe management of gense plant' s production, firmly believe and spread new strains of agricultural plant according to seed law and related legal regulation, and mediated in various quarrel by law, punish tort of new strains of agricultural plant in the course of preparation, production and sale.
