摘要
在算法时代,电商平台通知规则运行方式的自动化趋势不断加速。电商平台将面临通知数量激增与通知质量下降两大难题。通知规则的重塑应当以问题为导向,以服务于中国式现代化发展为目标。具体而言,在通知启动方面,明确发送通知的构成要件,规范自动通知的算法设计;在通知审查方面,利用算法技术辅助海量通知的筛查,通过协同治理阻断错误通知的危害;在错误通知追责方面,确立救济方式、明确责任主体、厘清主观状态。通过全链条、多方位的优化,使该规则能够持续为电商平台知识产权保护贡献力量。
In the era of algorithm,the trend of automation in the operation of notification rules on the e-commerce platforms is continually accelerating.E-commerce platforms will face the two major problems of the surge in the number of notifications and the decline in the quality of notifications.The reshaping of notification rules should be problem-oriented and aimed at serving the development of Chinese path to modernization.Specifically,in the aspect of notification initiation,the constituent elements of notification should be clarified and the algorithm design of automatic notification should be standardized.In the aspect of notification review,the algorithmic technology can be used to assist the screening of massive notifications,and the harm of wrong notifications can be blocked through collaborative governance.In the aspect of wrong notification accountability,the form of relief should be established,the subject of responsibility made clear,and the subjective state clarified.Through the optimization of the whole chain and multiple directions,the rule can continue to contribute to the protection of intellectual property on the e-commerce platforms.
