摘要
司法保护在知识产权法的演进与变迁中发挥重要作用。知识产权案件具有的 特性不仅对知识产权法官的审判能力提出了较高的要求,也呼唤与之相适应的诉讼与审判 制度。改革开放以来,中国知识产权司法取得了巨大成就,知识产权裁判机构组织体系不 断完善、审判领域大幅拓展、司法水平进一步提升,知识产权司法为健全国家知识产权治 理体系、完善营商环境作出了巨大贡献。但在取得成就的同时,中国知识产权司法仍然存 在不足,需要应对提升知识产权司法主导力、确保知识产权制度稳定性、依托新技术发展 构建智慧法院、打造知识产权司法国际竞争力等挑战。站在建设“创新国家”与“法治国 家”的交汇点上,须清晰梳理司法保护在知识产权治理变迁中的作用,结合技术创新的内 在规律,探索在当代中国法治实践中,使知识产权司法保护既契合法理规律又符合本土国 情的完善路径与策略,为创新型国家建设提供良好的知识产权秩序环境。
Judicial protection plays a significant role in the evolution and transformation of intellectual property(IP)law.The characteristics of IP lawsuits not only require the adjudicative capabilities of IP judges but also call for corresponding litigation and trial systems.Since the reform and opening-up,China has made great achievements in IP adjudication,with continuous improvements in the IP adjudication system,significant expansion of the field of IP trial,and further enhancement of judicial standards.IP adjudication has made great contributions to improving the national IP governance system and the business environment.However,China's IP adjudication still faces a lot of problems and challenges,such as enhancing the leading role of IP adjudication,ensuring the stability of IP system,building smart courts based on new technological developments,and fostering international competitiveness in IP adjudication.Standing at the intersection of an"innovative nation"and a"rule of law nation",it is essential to clearly outline the role of judicial protection in the development of IP governance,to explore the best way to optimize China's adjudication with combination of the internal rule of technology innovation,and to provide an IP order for the construction of an innovative nation.
