摘要
区域经济法作为调整区域经济结构、解决区域经济问题的新兴法律现象,以国家区域经济发展不平衡不充分的社会现实为背景,以区域经济结构失衡的法律治理为使命,以区域协调发展为法的价值目标。随着国家区域协调发展战略的进一步落实与深化,涉及调整区域经济现象的规范性文件越来越多,在经济法内部形成“区域经济法”的理论关切十分紧迫。讨论区域经济法知识体系建构应该具有的观念基础和立场方法,是基于推动经济法内部建立区域经济法价值共识的考量。在区域经济法知识生产过程中,观念、立场和方法不仅决定了研究问题的起点与方向,更深刻影响着区域经济法的本体认知和制度设计路径逻辑。一方面,共同体世界观统摄下的区域发展观以及实质正义观构成了区域经济法认识论、价值论与规范论的观念基础与思维范式。与此同时,基于区域经济现象的中观性、空间性和结构性,还必须以中观视野、空间维度和结构主义作为区域经济法的立场手段和分析方法,才能准确把握区域经济法的制度价值,这是深入推进区域经济法治建设的前提工程。
As a new legal phenomenon aimed at adjusting regional economic structures and addressing regional economic problems,regional economic law emerges against the backdrop of unbalanced and inadequate regional economic development in China.It takes the legal governance of structural imbalances as its core mission and upholds regional coordinated development as its fundamental value goal.With the deepening implementation of the national strategy for regional coordinated development,an increasing number of normative documents concerning the regulation of regional economic phenomena have been promulgated,making it urgent to establish a theoretical concern for"regional economic law"within the framework of economic law.Aiming to promote value consensus within economic law regarding regional governance,this paper discusses the basic concept and methodological stance required for constructing the knowledge system of regional economic law.In the process of knowledge production,concepts,stances and methods not only determine the starting point and direction of research,but also profoundly influence the ontological understanding of regional economic law and the logic of its institutional design.On the one hand,under the guidance of the community-based worldview,the regional development perspective and the view of substantive justice constitute the epistemological,axiological,and normative foundations of regional economic law.On the other hand,based on the principles of integrity,coordination,and fairness of economic law,it is also necessary to adopt a meso-level perspective,spatial dimension,and structuralist methods as the analytical stance and tools of regional economic law,in order to fully grasp its institutional value.This constitutes a foundational project for advancing the legal construction of regional economic governance.
