摘要
随着改革开放的不断深入,我国出现了一些较为发达的"特定区域"。这些特定区域对法治建设有更高的需求,却遇到了诸多法律上的瓶颈,也由此影响了这些特定区域经济发展和法治建设。经济与法治之间的密切关系,决定了特定区域经济的超前发展需要法治的先行作为支撑;同时,只有法治的先行才能促进特定区域经济的快速和高质量发展。要创新授权立法制度,通过国家权力机关对特定区域所在地的省、市权力机关直接的精准立法授权方式,允许他们在一定范围内突破或变通上位法,制定适合特定区域发展需要的地方立法。为实现特定区域的法治先行,必须对国家法治统一的含义作出新解读,法治统一并非机械地要求地方立法与上位法的完全一致;必须对地方间的法治公平进行重新认识,法治公平并不是法治建设的平均主义。
With the deepening of reform and opening-up, some developed ’specific regions’ have appeared in China. These specific regions have a higher demand for the construction of rule of law, but meet many legal bottlenecks, which affect the economic development and the construction of the rule of law in these specific regions. The close relationship between the economy and the rule of law determines that the advanced development of economy in the specific regions needs the advance of the rule of law as its support, and only the advance of the rule of law can promote the rapid and high-quality development of economy in specific regions. We should innovate the authorized legislation system, and allow the local legislative organs to break through the superior law within a certain range through state authority’s direct and precise legislation authorization to the provincial and municipal power organs in the specific regions, and to formulate local legislation adapted to the development needs of the specific regions. In order to realize the rule of law advance in specific regions, it is necessary to make a new interpretation for the meaning of the unity of national rule of law. The unity of the rule of law does not mean mechanically requiring the local legislation to be completely consistent with the superior law. It is necessary to have a new understanding of the fairness of the rule of law among local governments. The fairness of the rule of law is not the equalitarianism of the construction of the rule of law.
