摘要
全球信息革命推动人类社会迈进数字时代,数字技术赋能司法活动也随之迅速崛起。在数字技术赋能司法实践的过程中,不仅需要实现数字社会治理与激励数字经济发展的价值目标,更要坚守公平正义这一司法体系的核心生命线与终极价值追求。基于数字正义的司法观念,有效进行数字化变革中的司法体系建设、构建稳定的数字社会法治秩序,成为我国数字司法的重大时代使命。为实现数字司法的基本价值目标,在数字正义观及数字法治背景下,应针对司法实践中人工智能等技术在诉讼服务、智慧法院建设等方面的创新应用,结合我国数字司法面临的挑战,通过数字技术司法应用的定位、边界、场景及监管等具体路径来提升数字司法的效率与精准度。
Global information revolution has propelled human society into the digital age,with digital technologies rapidly empowering judicial activities.In the process of applying digital technologies to judicial practices,it is essential not only to achieve the value goals of digital social governance and fostering the development of the digital economy but also to uphold fairness and justice as the core lifeline and ultimate value pursuit of the judicial system.Based on the concept of Digital Justice,effectively advancing judicial system construction amidst digital transformation and establishing a stable legal framework for the digital society have become major missions for China’s Digital Justice initiatives.This study focuses on the fundamental value objectives of Digital Justice within the context of Digital Justice and the rule of law,examining the innovative applications of Artificial Intelligence and other technologies in litigation services and smart court construction.It further addresses the challenges faced by China’s Digital Justice landscape,proposing pathways such as defining the positioning,boundaries,scenarios,and regulatory frameworks of digital technology applications to enhance the efficiency and precision of Digital Justice systems.
