摘要
人工智能算法深度嵌入公共行政领域,不仅改变了传统行政模式,提高了行政效率,也引发了行政责任体系的根本性变革。算法技术嵌入行政体系重塑了政府责任内容、主体关系及科层结构,也导致了算法行政的三大问责困境,即主体维度上的权力解构与机制失灵、客体维度上的责任坍缩与权力弥散、内容维度上的标准模糊与价值失焦。在算法技术嵌入行政体系并逐步迈向算法行政时代的过程中,重构责任体系的路径是通过人机协同实现价值理性与技术理性的互补平衡,构建政企协同的公私责任分配框架并重塑融合“机制问责”与“德性问责”的复合型问责体系。加强对算法行政体系的问责,应以公共性维护为核心,通过制度创新实现技术赋能与责任约束的辩证统一,推动算法行政可持续发展。
The deep integration of artificial intelligence algorithms into public administration has not only transformed traditional administrative models and enhanced administrative efficiency but also triggered fundamental changes in the administrative responsibility system.It has reshaped governmental responsibilities,subject relationships,and bureaucratic structures,giving rise to three accountability dilemmas in algorithmic administration,namely power deconstruction and mechanism failure at the subject dimension;responsibility collapse and power diffusion at the object dimension;and standard ambiguity and value defocusing at the content dimension.As algorithmic technology embeds itself in administrative systems and advances toward an era of algorithmic governance,the path to reconstructing the accountability framework requires achieving complementary balance between value rationality and technological rationality through humanmachine collaboration.This entails establishing a public-private responsibility allocation framework through government-enterprise coordination and reshaping a composite accountability system integrating"mechanism accountability"and virtue accountability."Strengthening accountability within algorithmic governance systems must center on safeguarding public interests and realize the dialectical unity of technological empowerment and responsibility constraints with institutional innovation,thereby promoting the sustainable development of algorithmic governance.
