摘要
双边投资条约中蕴含着多边主义,多边主义为双边投资条约的多边化提供了理论基础。所以,双边投资条约需要从双边工具转向多边“连接点”,实现从自由主义向可持续发展模式的转型,彰显多边主义价值。事实上,双边投资条约最惠国待遇条款与投资争议仲裁条款在一定意义上实现了双边投资条约的“多边化”;冲突条款和例外条款反映了投资条约体系化要求;非排除措施条款,具有条约协同、解释指引作用,从根本上捍卫了人类命运共同体的更高位阶价值。中国应结合国际投资缔约实践,推动双边投资条约可持续发展的转型,促进国际投资多边规则与双边规则的良性互动,努力践行双边投资条约中的多边主义理念。
Multilateralism is embedded in bilateral investment treaties(BITs),which provides a theoretical foundation for the multilateralization of bilateral investment treaties.Therefore,BITs need to shift from bilateral instruments to“multilateral connection points”,realizing a transformation from a liberal model to a sustainable development model and highlighting the value of multilateralism.In fact,the most-favored-nation treatment clause and the investment dispute arbitration clause have,to a certain extent,achieved the“multilateralization”of BITs;the conflict clauses and exception clauses reflect the requirements for systematization of investment treaties;the non-exclusion measures clauses play a role in treaty coordination and interpretation guidance,fundamentally upholding the higher-order values of the community with a shared future for mankind.China should,in light of international investment treaty making practices,promote the transformation of BITs towards sustainable development,facilitate positive interactions between multilateral and bilateral investment rules,and strive to practice the concept of multilateralism in BITs.
