摘要
人工智能创作介入研究近来成为人工智能生成内容可作品性分析的关键视角,其呈现为创作的法律地位、组织形式以及实质贡献争议,反映出学界对于著作权法中“创作”概念的内核以及人工智能时代创作判定的认知分歧。技术演进通过开发新兴创作工具、催生新型创作方式,持续作用于著作权法中的“创作”,实质性扩展了“创作”概念的内涵与外延。与相机介入创作类似,人工智能参与的内容生成进程仍是在人类启动、主导和控制下以“人机协同”方式完成的。人工智能时代著作权法的创作范式已然转换,具体体现在创作的进程前移、贡献分散、形态异化、高度变革和重心偏移五个方面。在内容生产进程视角下,用户操作人工智能时的前端文词提示、中端文词修改与后端结果优化,可被视为一个整体性的创作行为,体现了著作权法中“创作”概念在人工智能时代的新发展。
Recent studies on the intervention of artificial intelligence(AI)in creative processes,which sparking debates over its legal status,organizational form,and substantive contribution in creation,have become crucial perspectives for analyzing the copyrightability of AI-generated content.This reflects academic divergences on the core concept of"creation"in copyright law and the determination of authorship in the AI era.The evolution of technology,through the development of novel creative tools and the emergence of innovative creative approaches,continues to impact the notion of creation in copyright law,substantially expanding both its connotation and extension.Similar to cameras in artistic creation,AI's role in content generation remains"human-machine collaboration"manner under human initiation,dominance,and control.Copyright law's paradigm of creation has shifted in the AI era,which is mainly reflected in five aspects:the advancement of creation time,the dispersion of creative contributions,the alienation of creative forms,the transformation of creative heights,and the shift of creative focus.From the perspective of content production process,user's front-end textual prompts,mid-end textual modifications,and back-end result optimizations when operating AI can be regarded as an integrated creative act,constituting a new development of the concept of creation in copyright law in the AI era.
