摘要
职业技能等级认定制度是由非国家性质的评价机构对劳动者的职业技能等级水平进行考核和认定的一种社会化技能人才评价制度。这种技能人才评价制度对高素质技术技能人才的培养、职业教育课程体系的完善以及技能型社会的建立具有教育导向作用。但是,目前职业技能等级认定制度的运行缺乏法治保障,因而存在职业技能等级认定权寻租、证书违规使用以及证书含金量差等矛盾,使职业技能等级认定制度的教育导向作用走向消极面向。所以,应当在明确职业技能等级认定权法律属性的基础上,建立公法与私法相结合的法律治理路径,健全公民监督机制,实现职业技能等级认定的依法治理,最终发挥其教育导向的正向作用。
The vocational skill level certification system is a socialized skill talent evaluation system in which non-state evaluation institutions examine and validate workers’vocational skill levels.This skill talent evaluation system plays an educational guiding role in cultivating high-quality technical and skilled talents,improving the vocational education curriculum system,and establishing a skill-oriented society.However,the current operation of the vocational skill level certification system lacks legal guarantees,leading to such problems as rent-seeking in vocational skill level certification rights,illegal use of certificates,and low value of certificates.These issues have made the educational guiding role of the vocational skill level certification system turn to a negative direction.Therefore,on the basis of clarifying the legal attribute of vocational skill level certification rights,it is necessary to establish a legal governance path combining public law and private law,and improve the citizen supervision mechanism.This will realize the law-based governance of the vocational skill level certification system and ultimately give play to its positive role in educational guidance.
