摘要
以往以制度修补为主的环境治理模式改革方案已无法应对系统性环境风险,故环境治理模式改革必须构建“政府—社会组织—企业”的三元横向预防型环境治理结构。在合规理论的指引下,企业要积极制定能够预防、识别并应对环境风险的环境治理合规计划,商会等社会组织则应帮助企业建立健全环境治理合规计划,并协助政府监督、评估企业环境治理合规计划的质效,政府则应对企业和社会组织的环境治理合规计划进行正反双向激励来刺激企业和社会组织,共同实现环境合作治理的新图景。
Traditional environmental governance model reform schemes primarily based on institutional patching are no longer able to address systemic environmental risks.Therefore,the reform of environmental governance models must respond to construct a tripartite horizontal preventive environmental governance structure of“government-social organizations-enterprises”.Guided by compliance theory,enterprises should actively formulate environmental governance compliance plans capable of preventing,identifying,and addressing environmental risks.Social organizations such as chambers of commerce should assist enterprises in establishing sound environmental governance compliance plans and help the government supervise and evaluate the quality and effectiveness of enterprise environmental governance compliance plans.The government should provide positive and negative dual incentives for the environmental governance compliance plans of enterprises and social organizations to stimulate their active participation,jointly realizing a new landscape of environmental cooperative governance.
