摘要
“全过程监管”是指围绕环境污染全过程展开的一系列监管政策和活动。现行污染防治单行法体系存在前端和后端延伸不充分、各污染防治监管内部及不同污染防治监管之间衔接不足,以及因分别采用不同的监管路径导致对同一阶段的监管出现重复规定的情况。生态环境法典编纂已经针对上述问题进行了一定的规范整合和建构,未来应进一步推动监管链条延伸、加强监管衔接并强化监管协同。
“The whole-process regulation”refers to a series of regulatory policies and activities that address all stages of environmental pollution.The current pollution prevention and control single line legal system has insufficient extension of the front-end and back-end,insufficient connection between different pollution prevention and control regulations,and due to the adoption of different regulatory paths,there may be duplicate regulations for the same stage of supervision.The compilation of the Environmental Code has made initial efforts to integrate and construct a more coherent regulatory framework in response to these issues.Going forward,further efforts should be made to extend the regulatory chain,enhance coordination across regulatory stages,and strengthen collaborative governance mechanisms.
