人工智能生成内容的属性认定与刑法保护限度 被引量:2

摘要 我国已构建了以民事确权和刑法规制为核心的著作权法律保护体系。人工智能生成内容法律属性的认定和权利归属,是刑法中人工智能生成内容法益识别的逻辑基础。基于读者中心主义的哲学逻辑与创作主体和权利主体二分的法律逻辑,可以破解人工智能生成内容作品属性认定的难题。从创作贡献度和收益分配合理性出发,将使用者作为人工智能生成内容著作财产权的适格权利主体,符合著作权法的法律理念和制度功能。著作权犯罪属于法定犯,遵循法秩序统一性和法定犯二次违法性原理,侵犯人工智能生成内容权利行为构成著作权犯罪的标准要与前置法规范保持一致。应在类型化视野下,严格筛选具有保护价值的人工智能生成内容,从对象与行为两个层面,明晰刑法保护人工智能生成内容的合理限度。 China has established a comprehensive copyright protection system centered on civil rights confirmation and criminal law regulation.The determination of legal attributes and rights allocation for AI-generated content serves as the logical foundation for identifying its protected legal interests in criminal law.The philosophical approach of reader-centrism combined with the legal principle distinguishing between creation subjects and rights subjects provides a solution for recognizing AI-generated content as copyrighted works.Considering both creative contribution and equitable benefit distribution,designating users as legitimate holders of property rights over AI-generated content aligns with copyright law’s fundamental principles and institutional purposes.As copyright infringement constitutes a statutory offense adhering to the unity of legal order and the secondary illegality doctrine,the criteria for establishing criminal liability must maintain consistency with pre-existing legal norms.A typological approach should be adopted to rigorously evaluate the protection-worthiness of AI-generated content,while reasonable boundaries for criminal law protection need to be clearly defined through dual examination of both protected objects and infringing conducts.
