摘要
伪造公司印章行为面临行政责任与刑事责任的界分难题,在生成式人工智能技术兴起的背景下该困境进一步加剧。其根源在于规范构造、法律解释与价值判断三个层面均存在局限。为解决这一问题,有必要从以下方面进行系统完善:在立法层面,应弥补现有规范结构的缺陷,实质化界定“伪造”的内涵,并构建由行政违法至刑事犯罪的梯度化责任体系;在解释层面,需消解认识偏颇,强化跨法域的层次化解释思维,坚持主客观要素相统一的认定原则;在价值判断层面,应厘清不同法益的主次关系,明确行政法与刑法各自的规制边界。面对人工智能所驱动的新型伪造行为,有必要超越以物理载体为中心的传统认定思路,在保障技术创新活力的同时,切实维护民营企业的合法权益。
The delineation between administrative and criminal liability for forgery of company seals presents a persistent challenge,which has been further intensified by the emergence of generative artificial intelligence technologies.This dilemma originates from limitations spanning normative construction,legal interpretation,and value judgment.To address these issues,systematic improvements are imperative:at the legislative level,it is essential to rectify deficiencies in the existing normative framework,substantively define the connotation of“forgery,”and establish a tiered liability system that progresses from administrative violations to criminal offenses;at the interpretative level,there is a need to resolve cognitive biases,strengthen cross-jurisdictional hierarchical interpretation,and adhere to the principle of unifying subjective and objective elements in determination;at the level of value judgment,clarifying the hierarchy of protected legal interests and demarcating the regulatory boundaries of administrative law and criminal law is crucial.Confronted with novel forgery methods driven by artificial intelligence,it is necessary to transcend traditional physical-carrier-centered identification approaches,ensuring both the protection of technological innovation and the legitimate rights and interests of private enterprises.
