高校学位授予权的理论调适与标准续造 被引量:4

Theoretical Adjustment and Standard Continuation of Degree Granting Authority in Higher Education Institutions

摘要 当前研究已普遍认为高校学位授予权系“行政属性+学术属性”的二元复合权,但由于两种属性界限不明,引发了套用比例原则等行政法原则对学位授予权进行规制的风潮。实际上,采用同属行政法原则的法律优先和法律保留原则检视可以看到,学位授予权的行政属性秉持低限度介入原则,仅要求其不违反法律的强制性规定。规制以学术权为核心的高校授予权应以法律强制性规定为边界、以高校章程自治为方法、以学术自主中的教育实质公平原则为内涵,方能确保学位授予权二元属性的妥适协调。高校应以此三点为原则具体规制学位授予权的行使并制定学位授予标准,确保高校学位授予权的教育法治化发展。 Current research generally believes that the degree granting power of universities is a binary composite power of"administrative attribute+academic attribute".However,due to the unclear boundary between the two attributes,there has been a trend of using administrative law principles such as proportionality to regulate the degree granting power.In fact,by adopting the principles of legal priority and legal reservation that belong to the same administrative law,it can be seen that the administrative nature of the degree granting power adheres to the principle of minimal intervention,only requiring it not to violate the mandatory provisions of the law.The regulation of the granting power of universities with academic rights as the core should be based on mandatory legal provisions as the boundary,the autonomy of university charters as the method,and the principle of educational substantive fairness in academic autonomy as the connotation,in order to ensure the appropriate coordination of the dual attributes of degree granting power.Colleges and universities should regulate the exercise of degree granting power based on these three principles and establish degree granting standards to ensure the legal development of degree granting power in education.
